TERMS AND CONDITIONS

By using this Web site, you signify that you have read these terms and conditions of our contract, and agree to be bound and comply with them. This apply to all visitors, users and others who access or use the Service whether they make any orders or not. We reserve the right to modify these terms at any time by publishing the modified terms online at this Web site. By continuing to access this site after such modifications are published, you signify your agreement to be bound by the terms as modified. If you disagree with any part of the terms then you may not access our Service.

PRODUCT IMAGES

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store, nevertheless as all our jewellery is entirely handmade and therefore there might be slight variations between the web pictures and the received pieces. As we use natural unique gemstones, the shade and colour might also vary from those shown on the web images. Some products may appear to be larger or smaller on the web than their actual size, as some images have been enlarged to make handmade detail more visible on the screen.

PRICING

All our products are made to order, therefore our pricing is based on the current market price of precious stones and materials, to give you the most competitive and fair pricing. If you would like a personalized quote for an item, click ‘Contact us' with the product name, and our team will be in touch with you. Prices on the website are for 14K gold, if you would like 18K, or add any other type of gemstone, please request the exact price for your preference before placing your order.

We try as much as possible to guarantee you the lowest possible while respecting our quality requirements. We reserve the right to adjust pricing until validation complete and payment of the order. We reserve the right at any time to modify or discontinue the production (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the production.

Displayed prices might be erroneous due to system problems or bad typographical filling, despite our efforts to avoid all kind of errors. If the price displayed is lower than the actual price of the product, we will contact you by email to either cancel the order or give you instructions relating to the payment of the price difference, as we cannot honour orders with incorrect information or prices.

Depending on the recipient country and the relevant import laws, duties and taxes may apply. These are not part of our pricing, as the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to. The payment of these is necessary to release your order from customs on arrival. Please note that we do not take responsibility for any duties, taxes or surcharges applied any specific country and we recommend that you check first prior to placing your order.

ORDERS

By placing an order, you attest to be at least 18 years old and have the legal capacity to place and honour any order or hold a specific valid parental authorization allowing you to place and honour your order and be able to justify it at any time. We inform you in writing of the progress of the manufacturing of your purchase and the shipment of your items.

Placing an order is done through the Site, by adding one or more products to the "basket". The customer is required to provide us with certain data concerning him in order to validate his order, and assumes responsibility for the accuracy of the information provided. The customer is required to check the details of his order including its total price, and if necessary correct any errors. The order is validated by checking the acceptance box of the T&Cs.

The production will not be started by Eterling until receipt of payment from the customer.

You have a period of fourteen days from receipt of the products to exercise your right of withdrawal, without justification or penalties. However, the majority of our jewelleries are made to order according to your specifications (choice of design, precious metal, precious stone, finger size for rings and bracelets, and a personalized engraving), these fall within the framework of exception n ° 3 of article L. 221-28 of the Consumer Code. Thus, for all these tailor made pieces (indicated on our website as deliverable in "three to four weeks" or more, or in general for any piece that you request to be engraved in a personalized manner), this right of withdrawal is not applicable, which you expressly acknowledge by this contract.

DEADLINES

All our jewellery is hand made to order which means that each piece is made especially for you. The usual deadline to prepare our rings is 4 weeks, but in case of specific gemstones it might vary. Please consult us to offer a precise turnaround time. If you need a piece before a specific date, please contact us before ordering to ensure this will be possible and to avoid any disappointment. Every effort will be made to have your piece to you as quickly as possible. Please note that turnaround times are an approximate guide and are subject to change or delay. The deadline for preparing bespoke jewellery with completely customized designs is always subject to personal consultation.

SIZING

We always recommend that our customers are professionally sized by a local jeweller where possible, as it’s the safest method. Be sure that you are given a precise size, mentioning the scale, as European, US, UK sizing are different. Please consult the sizing guide prior to ordering to ensure your order correctly.

If you have received your ring and you have ordered the incorrect size, the first thing to do is to contact us to arrange the next steps (you can reach our team by email or WhatsApp), and second, to establish your correct ring size by visiting a local jeweller.

Depending on the design, most of our pieces are able to be resized within a certain range (if not - like for full eternity rings - it will be confirmed by our team before your order). Resizing is done free of charge and under warranty. Customers will only be responsible for postage and delivery charges for resizing.

Conditions for resizing are the same than for return,

- Valid for all designs available on our website. Bespoke designs or jewellery which has been customized specifically to your requirement (e.g. rings with engraving) are not eligible
- The returned items must be undamaged and in a "new and unused condition" with all original documentation and packaging
- The jewellery has not been previously returned for resizing
- Your previous purchase has not been subject of a 30 days return too
- The jewellery has been returned within 30 days, the postmark is being taken as reference.

- Items showing obvious signs of wear or alterations by another jeweller will not be accepted.

Please note that you will no longer be able to benefit from the right to make a return or exchange for a piece of jewellery that has been resized.

The resizing time is three to four weeks.

PAYMENT

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

To protect your personal information, we take precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.

DELIVERY

We are pleased to provide worldwide delivery for your orders. Once your order is shipped, you’ll receive a tracking number via email so you can track your delivery. You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website. It is your responsibility to ensure that the delivery address you give us is correct and that there is somebody to sign for and take delivery of the goods from the delivery service used. Once goods have been delivered to you and you have signed the receipt, you will become the owner of the goods at your own risk, and we will not be liable for their loss or destruction. Delivery will be deemed to take place on the date of the first presentation of the products to the delivery address indicated.

If your package is returned to us by the carrier because the address is incorrect or you do not claim it within the time limit or you didn’t pay the import taxes, and you do not answer the phone and electronic messages to plan the new delivery, then Eterling Jewellery will keep the ownership right of the products and can freely dispose of them. We retain the payments that triggered the manufacturing of the product in the first place and you agree to have no recourse to recover the amounts paid or the unclaimed products.

We ship in standard carrier boxes that are non-descript for security, and are securely packaged to prevent damage during transit. Inside, each piece is placed in our elegant gift box. You can also add your personal message per piece, which you can specify while placing your order.

All of our shipping methods are fully insured so your pieces are covered whilst in transit. You will be responsible for signing for the receipt of your package. We cannot direct the shipper to leave your parcel anywhere, you will need to sign for the parcel in person. Once the piece is signed for, it is no longer considered in transit and is therefore under your direct responsibility.

As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these is necessary to release your order from customs on arrival. Please note that we do not take responsibility for any duties, taxes or surcharges applied any specific country and we recommend that you check first prior to placing your order.

CANCELLATION

We reserve the right to cancel the contract between you and us if we do not manage to acquire to specific precious stone required for your order, if we cannot arrange delivery to your geographical area, or the item you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers, in the event of failure of one of our suppliers, or in the event of force majeure.

We also reserve the right to cancel or refuse, without liability any order concerning a User, for good reason, in particular if there is a doubt or a dispute relating to a previous order by the User.

RETURNS & EXCHANGES

As it is important to us that you are completely satisfied with your purchase (especially when it is carried out remotely via internet), we offer a 30-day returns policy, starting from the date of dispatch, for a full refund or exchange*.

If you need to return your piece for some reason, please contact our team to let them know beforehand, and to start the return process together. To find out the procedure to follow in order to return your jewellery to us, you can reach our team by email or WhatsApp. Once we have confirmed the return process, you will be responsible for returning the piece to us.

You will need to package the piece/s in the original box or other sufficiently protective packaging to ensure their safety in transit and prevent any damage. You will also need to ensure that the piece is covered by insurance in transit, and that it is required to be signed for on delivery. Once your piece has arrived safely and been processed, our team will be in touch to confirm next steps.

The conditions for the 30 day returns policy are the following:
- Valid for all designs available on our website. Bespoke designs or jewellery which has been customized specifically to your requirement (e.g. rings with engraving) are not eligible for refund.
- The returned items must be undamaged and in a "new and unused condition" with all original documentation and packaging
- The jewellery has not been previously returned for resizing
- Your previous purchase has not been subject of a 30 days return too
- In the event of an order comprising several pieces of jewellery, the final return can only apply to one piece (this condition was established to protect us from abuse)
- The jewellery has been returned within 30 days, the postmark is being taken as reference.
- Items showing obvious signs of wear or alterations by another jeweller will not be accepted.

We respect the legislation in force concerning the product's lack of conformity to the Contract and unacceptable defects under the conditions provided in the Civil Code.

AVAILABILITY, ERRORS AND INACCURACIES

We are constantly updating our offerings of products and services on our website. Therefore we are not responsible if information made available on this site is not completely updated, accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting us primary. Any reliance on the material on this site is at your own risk. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

DISCLAIMER

Your use of the website is at your sole risk. The contents are provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

We do not warrant that the website will function uninterrupted, secure or available at any particular time or location, that the Service is free of viruses or other harmful components.

TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason. Upon termination, your right to use your account and our website will immediately cease. If you wish to terminate your account, you may simply discontinue using our website.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

We reserve the right to monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening or otherwise objectionable or violates any party’s intellectual property or these Terms of Service and to legally prosecute offenders.

If you send creative ideas or other materials, you agree that we may without restriction use in any medium any time without obligation to maintain any comments in confidence, or to pay compensation for any comments.

INTELLECTUAL PROPERTY

The content published on our website – whether they are deposited with copyright or not - is under design protection and the property of Eterling Jewellery. All content – whether text or pictures – on the website are the property of Eterling Jewellery and they can only be reused with our written consent.
